MEMORANDUM OF ASSOCIATION

Article 1:              Name

1.1          This organization shall be called the Nova Scotia Junior Hockey League and shall be comprised of teams located in Nova Scotia. 3June2006

Article 2:              Definitions

2.1          In these By-Laws unless there be something in the subject or context inconsistent therewith;

2.1.1                                                       Society                                   means the Nova Scotia Junior Hockey League.

2.1.2                                                       Registrar                                means the Registrar of Joint Stock Companies under the Nova Scotia Companies Act.

2.1.3                                                       Special Resolution               means a resolution passed by not less than three-fourths of such members entitled to vote as are present in person or by proxy, where proxies are allowed, at a general meeting of which notice specifying the intention to propose the resolution as a special resolution has been given.

2.1.4                                                       Team                                     means a recognized hockey team in the Nova Scotia Junior Hockey League.

Article 3:              Authority

3.1          The league, operating with the approval of and under the authority and jurisdiction of Hockey Nova Scotia (HNS), has full and complete jurisdiction over all Junior Hockey in the Nova Scotia Junior Hockey League. 2001.Jun..09

3.2          The league will, prior to the commencement of the regular season play, register with Hockey Nova Scotia(HNS), the governing body of amateur hockey in Nova Scotia. 2001.Jun..09

Article 4:              Objects

4.1          The objects of the organization are:

4.1.1           to foster and encourage the support of amateur junior hockey throughout Nova Scotia;

4.1.2       to sponsor and encourage clean hockey and to discourage unsportsmanlike tactics by either individual players or team officials; 1999.AUG.22

4.1.3       to co-operate with educational institutions to ensure that hockey does not adversely interfere with a student's education; 1999.AUG.22

4.1.4       to ensure that the basic human rights of all individuals are respected; 1999.AUG.22

4.1.5       to supervise and carry out hockey contests within the league and to eventually declare a Provincial Champion; 1999.AUG.22

4.1.6       to acquire by way of grant, gift, purchase, bequest, devise or otherwise, real and personal property and to use and apply such property to the realization of the objects of the society; and

4.1.7       to buy, own, hold, lease, mortgage, sell and convey such real and personal property as may be necessary or desirable in the carrying out of the objects of the Society.

Provided                that nothing herein contained shall permit the Society to carry on any trade, industry, or business and the Society shall be carried on without purpose of gain to any of the members and that any surplus or any accretions of the Society shall be used solely for the purposes of the Society and the promotion of the objects.

Provided                further, that if for any reason the operations of the Society are terminated or are wound up, or are dissolved and there remains, at that time, after satisfaction of all its debts and liabilities, any property whatsoever, the same shall be paid to some other charitable organization in Canada, having objects similar to those of the Society.

Article 5:              Activities

5.1          The Activities of the Society are to be carried on in the Province of Nova Scotia.

Article 6:              Membership

6.1          The subscribers to the Memorandum of Association and such other persons or teams as shall be admitted to membership in accordance to these By-Laws, and none other, shall be members of the Society, and their names shall be entered in the Registry of Members accordingly.

6.2          For the purposes of registration, the number of members of the Society is unlimited.

6.3          Membership in the Society shall not be transferable.

6.4          The Nova Scotia Junior Hockey League shall be comprised of two divisions which shall be known as the "Fred Fox Division" and the "Sid Rowe Division". The divisions shall be identified by geographical boundaries and shall contain teams listed in Schedule AA@: 29 Jul 06

6.5          Team(s) on a one years leave of absence shall be identified in Schedule AA@. 2002Jun15

Article 7:              Amendments

7.1          The By-Laws and/or Regulations may be amended or altered only by a special resolution of no less than three-fourths of the voting members present at any League, Special, or Annual Meeting of the Society. 18.JUN.97

7.2          No amendments or alterations to the By-Laws or Regulations shall be considered at any Meeting, unless such proposed amendments or alterations have been submitted, in writing, to the Secretary of the Nova Scotia Junior Hockey League at least two weeks prior to the date of such Meeting. 18.JUN.97

7.3          It shall be the duty of the Secretary to submit a copy of the proposed amendments or alterations to the President and to each team representative, where possible, at least one week prior to such Meeting. 15.JUN.02

BY-LAWS

By-Law 1:           Board of Governors

1.1_            The league shall be governed by a Board of Governors which will establish the policies of the League, and uphold the Memorandum of Association, By-Laws and Regulations, as provided herein. 1999.AUG.22

1.2_            Appointment of Governor

a)            Each member team shall appoint an individual as a governor of the league and one alternate. Any member of a teams coaching staff is not acceptable as a Governor or as an alternate. 1999.AUG.22

2)                   Such appointment shall be in writing, signed by a member team official, and a true copy thereof shall be filed with the Secretary, Nova Scotia Jr Hockey League.

c)                   In the event of a Governor or an alternate being unable to attend a meeting, the member team may appoint, by a similar writing filed with the Secretary, an alternate Governor to represent it at such a meeting with all the power of a Governor. 1999.AUG.22

d)                   Any member team may, at any time in writing, revoke its Governor and appoint another Governor to represent it. 1999.AUG.22

1.3          Meetings of Board of Governors

a)                   At any and all meetings of the Board of Governors, unless otherwise stated, each member team of the League shall be entitled to have present at such meeting three (3) representatives. 2002Jun15

b)                   A quorum for meetings of the Board of Governors shall be two-thirds (2/3) of the member teams of the League. 1999.AUG.22

c)                   Voting at a Board of Governors Meeting shall be limited to the Governors in attendance, or in the absence of a Governor, the teams appointed alternate. 1999.AUG.22

d)                   The Governor or his alternate shall, by reason of his appointment, be vested with the full power to represent the member team and to bind it by his vote. 1999.AUG.22

e)                   At all meetings of the League, representation of each member team by its Governor or alternate shall be compulsory. Failure to have representation, without due cause shall result in the member team being subject to a fine of two-hundred and fifty ($250.00) dollars. The Board of Governors may waive the fine when due cause is shown. 2008May31

1.4          Duties of the Board of Governors

a)                   To annually elect from amongst themselves a Chairman of the Board, who shall chair all subsequent meetings of the Board of Governors. 2000.JUN.14

b)                   To approve, amend or alter the League's Memorandum of Association, By-Laws and Regulations. 1999.AUG.22

c)                   To approve League expansion by the admission of new team(s) and to set the franchise fees applicable to new team(s) entering the League. 1999.AUG.22

d)                   To approve the League's divisions and the alignment of League Teams within those divisions. 1999.AUG.22

e)                   To approve the league regular season schedule and the playoff format. 1999.AUG.22

f)                    To approve the expulsion of any team from the League, set any conditions, penalties or disciplinary action against such team or team(s) so expelled from the League. 1999.AUG.22

g)                   To elect, at the Annual Meeting, the League President and the League Executive.

h)                   To approve the League's Supplemental Code of Discipline, if appropriate, and to make recommendations to HNS for changes to the HNS Junior Council Code of Discipline as they relate to Junior hockey. 2002Jun15

i)                     To administer League discipline against teams for violation of any provisions of the League

                Memorandum of Association, By-Laws, Regulations or Protected Lists. 1999.AUG.22

j)                    To designate an Executive Member to administer the League's disciplinary matters for the operation of teams in the League and the conduct of team officials, players or club organizations during the year. 1999.AUG.22

k)                   To establish a Marketing Committee, if required, to assess and direct the marketing policies of the League. 1999.AUG.22

l)                     A member team may request the Chairman of the Board of Governors to establish a special committee to:

investigate player movements;

investigate tampering violations;

recommend release procedures (if appropriate);

recommend the amount of fine and/or compensation to be levied,

Such committee shall report it's findings and recommendation to the Board of Governors for its approval. 1999.AUG.22

m)                 To establish other committees as may, from time to time, be deemed necessary. 1999.AUG.22

By-Law 2             Management

2.1          Management of Affairs

The management of the affairs of the Nova Scotia Jr Hockey League shall be vested in an elected Executive Committee, consisting of a President, two (2) Vice-Presidents who shall be elected, plus a Secretary, Treasurer, Public Relations Director, Statistician, and Website Director, who shall be appointed. The office of Secretary and Treasurer may be combined and held by one and the same person. 31May2008

2.2          Term of Office

The President and two (2) Vice Presidents shall be elected for a three (3) year term at the League AGM as follows:

Year 1                    -               President

Year 2                    -               VP Fred Fox Division

Year 3                    -               VP Sid Rowe Division.

Remaining members of the Executive Committee shall be appointed to a one (1) year term by the Executive at the League AGM. 29 Jul 06 

2.3                                                                                          Executive Right To Vote                   

The Officers of the League Executive Committee shall not have the right to vote at any League Meeting, excepting in the case of a tie vote. In the event of a tie, the Chair shall have the tie breaking vote.

2.4          Suggestions and Recommendations

The Officers of the League Executive Committee shall be expected to bring forth suggestions and recommendations dealing with any area of the operation of the league.

2.5          Executive Empowerment - Re: Contracts, Deeds, Etc

The Officers of the League Executive Committee shall be empowered to execute all necessary contracts, deeds, bills of exchange, as well as other instruments and documents on behalf of the Society.

2.6          Society Seal

The Seal of the Society, where such Seal exists, shall be in the custody of the Secretary, who shall keep it available for use on all documents requiring the Seal of the Society.

2.7          Protest Committee

A "League Protest Committee" shall consist of the following members:

Inter-divisional protest:                      Division Vice-President (as chair), and any three (3) of the opposing divisions Governors. The Governors serving on the committee, shall be arranged by the chair.

Cross-divisional protest:                     Either Vice-President (as chair), and any four (4) independent Governors, two from each division. The Governors serving on the committee, shall be arranged by the chair.

The chair, in any protest, shall not have a vote except in the event of a tie, and then his or her vote shall be used to break such tie. 1999.AUG.22

2.8          Disciplinary Committee

The League Disciplinary Committee shall consist of the League President and the two Vice-Presidents. The Chairman of the Board of Governors may act as an alternate. 5Jun04

2.9          Jurisdiction of Issues

Sole jurisdiction in the matters as listed shall be vested as noted: 1999.AUG.22

By-Law 3             Duties

3.1          The President=s duties shall consist of: 15Jun02

3.1.1       The President shall preside at all League Meetings. 15Jun02

3.1.2       The President shall generally perform the duties usual to the office of the President. 15Jun02

3.1.3       The President, besides his regular duties, shall carry out all duties and powers of the League Executive in case of an emergency. Any such decision to be ratified within fifteen days of such decision by League Membership. 15Jun02

3.1.4       The President or the Executive Member approved by the Board of Governors, or in his absence, his delegate, shall have the power to suspend and fine any player, team, or team official whose action is prejudicial to good sportsmanship, or who violates the playing or League rules and regulations. 5Jun04

3.2          The Vice-President=s duties shall consist of:

3.2.1       The Vice-President shall preside at League Meetings in the absence of the President. 15Jun02

3.2.2       The Vice-President shall generally perform the duties usual to the office of the Vice-President.

3.2.3       The Vice-President, in the absence of the President, shall carry out all duties and responsibilities normally carried out by the President. 15.Jun02

3.3          The Secretary's duties shall consist of:

3.3.1       The Secretary shall perform all general secretarial duties including the recording and issuing of the minutes of all League Meetings and Committee Meetings as required; the records of all players, coaches, managers and trainers as registered with the governing body and perform such duties as may devolve upon him/her as League Secretary as designated by the President. 15Jun02

3.3.2       The Secretary shall conduct all correspondence, issue notices of all meetings and assist in other general duties as required.

3.4          The Treasurer's duties shall consist of:

3.4.1       The Treasurer shall keep the financial records of the League, receive all monies of the League and deposit same in a chartered bank.

3.4.2       The Treasurer shall present a properly prepared financial statement each year at the annual Meeting covering in detail all monies received and monies disbursed.

3.4.3       The Treasurer shall make the books and records of the Society available for inspection by any member upon reasonable notice and during reasonable hours.

3.5          The Statistician's duties, under the direction of the President, shall consist of: 15Jun02

3.5.1       The Statistician shall be responsible for the gathering of all statistical information pertinent to the outcome of regular season and playoff games, as well as all individual players, and making same available to all news media. 1999.JUN.30

3.5.2       The Statistician shall in all regular games, credit the winning team with two points and, in the case of a tie, credit the participating teams with one point each. In the case of an overtime win, credit the winning team with two points and the losing team with one point. 12.SEP.95

3.5.3       The statistician shall make all available statistical information accessible to all teams within the NSJHL, as well as other interested parties. 1999.JUN.30

3.5.4       The statistician shall, after determining teams preferred game days/times, draft a schedule for the regular season. 2001.Jun..09

3.6          The Publicity Director's duties, under the direction of the President, shall consist of: 15Jun02

3.6.1       The Publicity Director shall be responsible for the gathering of all information pertinent to the League operations and making same available to all news media. 1999.JUN.30

3.6.2       The Publicity Director shall be responsible for the guidance of the operations of the individual teams' publicity representatives as required, upon the approval of the President. 15Jun02

3.6.3           The Publicity Director shall accept all prepared statements by the President or the League Executive for media release as required. 15Jun02

3.7          The Website Director's duties, under the direction of the President, shall consist of:

3.7.1           Liaise with the Website provider to co-ordinate enhancements to the site as required by the Board of Governors.

3.7.2           Assist member teams with problems on their individual sites. 31May2008

By-Law 4:           Vacancy of an Executive Committee Position

4.1          When other than by expiration of the term of office, any Executive Position becomes vacant, the membership shall appoint, by majority vote, one of it=s members to fill the vacant position for the unexpired portion of the term of office.

By-Law 5:           Teams

5.1          Each participating member team shall have an executive to be known as the Team Executive of not less than three responsible persons. For the purposes of this article, the team shall be deemed to be located in the area in which it plays it home games.

5.2          Each participating member team shall be entitled to have three representatives at any League Meeting, but only one representative from each team shall be entitled to vote at any League Meeting. Prior to the commencement of any meeting, each team shall indicate to the Secretary who their voting representative shall be for that meeting.

By-Law 6:           Voting

6.1          Each participating member team shall be entitled to one voting representative at any meeting of the League.

6.2          There shall be no proxy voting at any meeting of the society.

6.3          All motions put forward at any League Meeting shall be carried only by a majority vote of the voting representatives of each participating team present. 12.SEP.95

6.4          An application made under the By-Laws and regulations must be approved by the majority of the participating member teams present at any League Meeting or, in the event of an emergency, the Secretary is empowered to make a telephone or e-mailvote of the participating member teams provided that, in the sole discretion of the League Executive, the application is of an emergency nature. Any such telephone or e-maol vote must be confirmed and ratified at the first League Meeting following the taking of such telephone or e-mail vote.30may09

By-Law 7:           Fiscal Year

7.1    The fiscal year of the Nova Scotia Junior Hockey League shall be the period from 01 MAY in any year, to 30 APR of the following year. 12.SEP.95

By-Law 8:           Meetings

8.1          The Nova Scotia Junior Hockey League shall hold an annual meeting within 2 months after the end of each fiscal year with the exact time and place to be set by the President. 15Jun02

8.2          The President, or in his absence, a league member designated by the Commissioner/President, shall preside at the Annual Meeting. 15Jun02

8.3          A majority of the participating member teams shall constitute a quorum at all League Meetings.

8.4          Roberts Rules of Order shall apply at all meetings at which a jurisdictional dispute arises.

By-Law 9:           Special Meetings

9.1          Special Meetings of the League may be called by the League Executive at any time. A Special Meeting may also be called by an application to the Secretary by a majority of the participating member teams and, when such application is received, the League Executive shall call a Special Meeting.

By-Law 10:         Fees

10.1        The admission fee for teams accepted as participating member teams pursuant to these By-Laws shall be ten thousand dollars ($10,000.00) payable as follows: $5,000 on acceptance to the League; and $2,500 prior to start of second season, or sooner; and $2,500 prior to start of third season, or sooner. 3June2006

10.2        Each team shall be assessed an Annual League Assessment. The amount to be decided at the Annual General Meeting, based on the proposed League Budget. This assessment may be paid in three installments - on or before August 31st, on or before November 30^th, and on or before January 31st. Post-dated cheques must be received by the Treasurer no later than August 31^st. The Treasurer must deposit the cheques within three business days of the date on the cheques. 2008May31

10.2.1     One hundred dollars ($100.00) of the teams annual membership fee shall be given back to any team not qualifying for the Nova Scotia Junior Hockey League playoffs.  2001.Jun.09

10.3        A Performance Bond deposit will be duly levied and no team shall be authorized to take part in any regularly scheduled game unless their Performance Bond Deposit is in fully paid status with the League, no later than September 15th of the current year. The amount of said Bond is to be five hundred dollars ($500.00), and if the team continues in the League to end of Regular Schedule, the Bond will be refunded on request, providing that all financial obligations to the League have been met. New teams will pay one thousand dollars ($1,000.00) the first season, refundable at the end of the first season. 2002Jun15

10.4        In the event of a team having submitted a cheque that is returned as being Aunpayable@ for any reason what-so-ever, the league will assess a charge to that team equal to any and all charges levied by the financial institution for handling such item, plus a $100.00 handling charge. 2008May31

By-Law 11:         Protests  

11.1                        a)            Protests may only be made in regards to interpretation of Rules, By-Laws, Regulations, Rules of Competition and Constitutional matters, not in regard to the decision of a Referee or Linesman. 17Jul02

b)                   A verbal protest must be made by the Captain of the aggrieved team to the Referee at the first reasonable opportunity after the action or decision complained of, and in all cases must be made within five (5) minutes of the close of the period in which such action or decision was made and same must be noted immediately on the Official Game Report. 17Jul02

c)                   When a protest arises and the protesting team has complied with By-Law 11.1(b), then within 24 hours of the completion of the game protested, a FAX or written protest, signed by the President or Secretary of the protesting team must be in the hands of the League Secretary, and must be accompanied by a certified cheque in the amount of Two Hundred Dollars ($200.00). A copy of such FAX or written protest must also be served upon the protested club within 24 hours of the game protested. 17Jul02

d)                   The team protested shall, within 48 hours after the completion of the game protested, file its defence with the League Secretary and a copy of such defence shall also be served on the President or Secretary of the protesting team within 48 hours after the completion of the game protested. 17Jul02

e)                   The President shall fix a time and place for the meeting of the League Protest Committee to consider the protest. Each of the teams interested may have a person to present its case at the hearing of the protest. 17Jul02

11.2        No appeal to the league shall lie from any decision handed down by the League Protest Committee with respect to any protest filed pursuant to By-Law 11.1. An appeal shall be allowed from the decision of the Protest Committee to the Hockey Nova Scotia (HNS) President in accordance with HNS Regulation 7. 17Jul02

11.3        Should the protest be upheld by the League Protest Committee, then the protest fee of Two Hundred Dollars ($200.00) less League expenses shall be returned to the protesting team. 17Jul02

11.4        Notwithstanding the above, a protest fee of Two Hundred Dollars ($200.00) shall not be necessary if the participating member should present to the League Protest Committee sworn documented evidence that the By-Laws and Regulations of the League have been clearly infringed upon or broken.

By-Law 12:         Banking

12.1        The Executive Committee shall arrange for the opening of a Bank Account in some Chartered Bank or Trust Company in which funds for the Nova Scotia Junior Hockey League shall be deposited and withdrawals made only by the Treasurer and the President or one other person, who shall be recognized as the signing officers of the League. 2002.Jun.15

12.2        The President, the Treasurer and one League Member shall be the signing officers of the League, any two signatures required. 2002.Jun.15

12.3        The Executive Committee shall be responsible for the payment of all accounts of the Nova Scotia Junior Hockey League and shall make such regulations as it deems necessary to deal with payment of regular current accounts. 12.SEP.95

12.4        The Treasurer shall have an independent recognized person conduct an annual audit of the League's financial statement at year end (Apr 30th). This shall be presented to the membership teams at the annual meeting. 2001.Jun.09

By-Law 13:         Officers

13.1        No member of a team Executive, or coaches, managers or trainers of any of the participating member teams shall be eligible for appointment to the League Executive. 12.SEP.95

By-Law 14:         Franchise Operation

14.1        Each of the operating Member Teams shall be issued a Certificate of Franchise, signed by the President and Secretary of the League, indicating that the said Team is a participating member of the League in good standing. 15Jun02

14.2        The Nova Scotia Junior Hockey League shall be stabilized at a minimum of six clubs, this number to be revised at each Annual Meeting. 12.SEP.95

14.3        Except in the case of a vacancy, application for admission to the League will be at the next Annual Meeting and acceptance shall be only by majority vote. 11.SEP.96

14.4        Notwithstanding the previous subsection, application for admission to fill such a vacancy may only be considered and accepted provided that such application can show that there is already existing the nucleus for a good club in the Applicant's area.

14.5        Any of the participating member teams may make written application to the Secretary to alter any of the conditions of their operation at any time, providing the alteration, if approved by the League in a meeting, would not conflict with any of the provisions of the League's By-Laws or Regulations. 12.SEP.95

14.6        The following shall be deemed to be conditions of a team's operation: 12.SEP.95

14.6.1     The Team's Name

14.6.2     The Team's Colour

14.6.3     The Location of Home Rink

14.6.4     The Team's Executive

14.7        Should a team apply to the Nova Scotia Junior Hockey League to move its franchise permanently to another rink for home games under Section 14.6.3 at any time prior to or during the schedule, such a move, if it be a distance of twenty-five miles or more, shall be approved by unanimous vote of all teams at the Annual or Special Meeting called by the League Executive at which time the application is heard. 12.SEP.95

14.8        Any club franchise may be subject to forfeiture in the event of failure to comply with any requirements of this Constitution or any By-Law hereunder or any duly recorded League Minutes. Actual forfeiture or suspension will be effected subsequent to a Special League Meeting called by the League Executive.

14.9.1       Any application received from teams for admission to the Nova Scotia Junior Hockey League, or change of home rinks for existing teams, must receive the support of a simple majority of the teams in the League . 4Jun2005

14.10          Leave of Absence may be granted by the Board of Governors to any member team subject to the following              conditions:

                a)            The Leave must be applied for at least two weeks prior to the Annual General Meeting

                b)            The Leave must be approved by a two-thirds majority of the active League members

                c)             Any Leave of Absence will be in effect for one year and may be renewed for a second season

d)            Notification to return to active status must be received by the President no later than March 31 of the year of the Leave of Absence

d)                   League assessments totaling 60% (sixty percent) of team assessment must be submitted when assessments are due for that playing season (Leave of Absence season), failing which the franchise shall be forfeited

f)             Any member team granted a Leave of Absence shall forfeit it’s right to vote at League and BOG meetings whilst on leave, but will have the right to attend all League meetings and to receive copies of all minutes, notices and correspondence which may be distributed to League members. 26Jul2008

By-Law 15:         League Passes

15.1        The Annual League Pass shall be a combined Jr "A" and Jr "B" pass with each team to be issued 8 such passes. 12.SEP.95

15.2        Each Executive Committee member shall receive Annual League Passes the number of which shall be determined by the number of passes remaining after the teams allocation of passes. 1999.AUG.22

15.3        Annual League Passes shall be honoured at all NSJHL Regular Season, Playoff, and NSJHL

All-Star Games. 14 JUN 03

By-Law 16:         Discipline

16.1        The League may, from time to time, adopt minimum suspensions or penalties to be imposed on offending team players and officials. If such a minimum suspension policy is in effect in the League, whether by adoption or through the Governing Branch (HNS), if the Officer responsible for discipline imposes a penalty in excess of the established minimum, the recourse for appeal is to Hockey Nova Scotia (HNS). 9Jun07

16.2        In exceptional circumstances, the President or his designate may suspend a team, player or official pending a suspension hearing, if he determines that such action is necessary to preserve the integrity of the League or for other good cause. 5 Jun04

16.3        There shall be no hearing or appeal from minimum suspensions issued under a minimum suspension policy. 5Jun04

By-Law 17:         Miscellaneous

17.1        Where any matter is not dealt with in the By-Laws or Regulations of the Nova Scotia Junior Hockey League, but is dealt with in the HNS(Hockey Nova Scotia) Governing Body Handbook, then the provisions of the said "Handbook" shall apply. Provided, however, that any matter not dealt with in either of the By-Laws or Regulations or in the Hockey Canada Handbook shall be dealt with at any League Meeting. 2001.Jun.09

REGULATIONS

Regulation 1:      Teams

1.1          Participating member teams shall, during all scheduled games of the League, dress a minimum of ten players, one of whom shall be a spare goaltender or a designated player who shall be, if necessary, the spare goaltender and failure to abide by this Regulation will result in a fine of two hundred dollars ($200.00). The President has the sole discretion to waive this fine in the event of special circumstances. 2002Jun15

1.2          Each participating member team shall be allowed to dress the maximum number of players as per the Hockey Canada Handbook. 2001.Jun.09

1.3.1       Each participating team shall be permitted to sign and dress a maximum of four (4) over-age players in accordance with HC Regulation B3. 2010.May.29

1.3.2           Any player in his last year of eligibility in Junior “A” or higher category or 20 year old CIS players who come to the NSJHL from these categories will not be eligible to play as an over-ager in the NSJHL. 2010.May.29

1.4          Each participating member team shall indicate to the Secretary in writing on or before the 15th day of September of each year, the names, telephone numbers, fax numbers, e-mail addresses, and mailing addresses of the Team Executive. Such Team Executive, when recorded by the Secretary, shall be deemed to be the Team Executive referred to in the Franchise Certificate and shall continue to be that Team's Executive until such time as any changes might be made in accordance with the By-Laws or Regulations of the League. 2002Jun15

1.5          Each participating member team shall indicate to the Secretary, in writing, on or before the 15th day of September of each year, the name, telephone number, fax number and mailing address of the Team Contact person. 18.JUN.97

1.6          Each proposed Team Executive List forwarded to the Secretary shall be scrutinized and approved by the League Executive before they are filed with the Secretary.

1.7          If the League Executive should decide that any proposed Team Executive or any proposed member of the Team Executive does not meet the requirements of Article 5.1 of the By-Laws of this League, the League Executive shall meet with representatives of the team in question before making any final decision for rejection. The said representatives shall have the opportunity to question any grounds for any proposed rejections and should any explanation in relation to the said grounds not be acceptable, the Team executive shall be given the opportunity to submit further proposed Executives. 2002Jun15

1.8          Each of the participating member teams shall indicate to the Secretary, in writing, at least two weeks prior to the Annual Meeting whether each team intends to participate in the League the following season. The Secretary is to contact any club not heard from by the deadline. In the event of vacancy, applications for admission, in accordance with Article 14 of the By-Laws, will be handled at the Annual Meeting or a Special League Meeting called for that purpose. 2002Jun15

1.8.1       Commencing with the 2007/2008 season, any team having indicated their intent to participate IAW Regulation 1.8 and subsequently requests a Leave of Absence after the Annual General Meeting shall be required to pay a Re-admission fee equal to fifty percent (50%) of the Annual League Fee prior to re-admission. This fee is in addition to normal Annual League Fee. 21 Jan 2007

1.9          For all regular schedule games and League Playoffs, the home club shall provide security in the form of Police, Security Guards or RCMP, a minimum of one per Regular League Game, and at the discretion of the League Executive in the League Playoffs. Failure to comply with this Regulation will result in a minimum fine of one hundred dollars ($100.00) for the first offence and possible forfeiture of game, and in the case of repeated violations, possible suspension of franchise. 2001.Jun.09

1.10        After the specified deadlines, the Secretary shall obtain all pertinent information regarding affiliate teams, affiliate players, club systems and player lists for affiliate teams, from the Branch Secretary Registrar and will circulate same to the League. 2001.Jun.09

1.11        Matching socks, sweaters, pants and CSA approved helmets/visors must be all of the team's designated colour(s). Failure to meet any of the aforementioned requirements after the first month of the League's Regular Schedule may result in a fifty dollar ($50.00) fine (to be paid by the team) for each player improperly dressed in every game. 2002.Jun.15

1.12        Any/all players not wearing a fastened chin strap in accordance with Hockey Canada rules during the Warmup shall be levied a fifteen dollar ($15.00) fine. This fine may be assessed by any League Executive member in attendance 2009May30

1.13        A warning buzzer will be sounded with two (2) minutes remaining in the Warmup period. When the final buzzer signifying the end of the Warmup period sounds ALL players are to be off the ice. Home teams may designate a maximum of two (2) players to retrieve pucks from the ice as quickly as possible. 2002Jun15

1.14        2002Jun15     All intermissions shall be of fifteen (15) minutes duration. A warning buzzer will be sounded at the thirteen (13) minute mark, and when the final buzzer sounds signifying the end of the intermission, all players must be on the ice or the players bench. Infraction of this regulation will result in Delay of Game penalties. 

1.15        2007Jun19No team shall hold a training camp prior to 1 September each season.

1.16        Imports are as defined by Hockey Canada, except that in the League any player who is once an import will remain classified as an import throughout his entire Junior career. The exception to this will be players who played their last year of Bantam eligibility in one of the Atlantic provinces (NS,NB, Nfld, PEI). Such players will be classified as an import only when classified as an import by Hockey Canada. 2008May31               

1.16.1     9Jun07Teams may have signed at any one time no more than six (6) imports. If an affiliate player is an import under this regulation, that player may play with the team provided that no more than six (6) imports (signed and affiliate) are dressed for any game. 

1.17        Players who have been rostered and have played Major Junior Hockey are not eligible to play in the NSJHL. This does not include 17, 18 and 19 year old affiliates registered with HNS teams or 17, 18 and 19 year old Nova Scotia players. Nova Scotia players are defined as players who have played their Bantam or Midget hockey in Nova Scotia. 29May 10

Regulation 2:      Players

2.1          No player shall participate in any Regular or Playoff Game in the League unless that player is registered in accordance with the governing body handbook.

2.2          Any player who participates in contravention of the preceding paragraph shall be suspended forthwith by the League Executive. The participating member team for whom that player played shall forfeit all points earned while using such player and shall be fined the sum of five hundred dollars ($500.00). 12.SEP.95

2.3          No player signed by any of the participating member teams shall be paid money for playing for such participating member team but may be reimbursed for any expenses legitimately incurred as a result of playing for any team and in any event, but not so as to restrict the generality of the foregoing, may be reimbursed for such items as necessary travel expenses, travelling during League and Playoff Games. 12.SEP.95

2.4    Where a player has accepted money for his services in contravention of the preceding paragraph, such player shall be suspended by the League Executive and the team involved may be fined one thousand dollars ($1,000.00), which fine is to be paid to the Treasurer prior to the next scheduled League or Playoff Game. Any game(s) this player has played in shall be automatically forfeited to the opposing team. 12.SEP.95

2.5.1           All player trades must be approved by the League Executive. All terms and conditions must accompany the trade. All trades within the League are to be respected by member teams. Under no circumstances will a member team sign a player who does not report to the team he has been traded to. 7Aug10

2.5.2       Any and all player disputes will be handled by the League Executive. 7Aug10

2.5.3       All teams are entitled to a 28 man Protected List which shall include all carded players. Un-carded Over-age players may only remain on the teams Protected List until 1 November. Any player who leaves to play in any other league may be included in the 28 man Protected List. Protected List and changes to the list are to be forwarded to the League Executive. 7Aug10

2.5.4           All player transactions regarding Waiver Draft are to be completed within 72 hours. 7Aug10

2.5.5           Should a player be released from a member team and not be picked up by another member team via the waiver draft he may be placed on the releasing teams Protected List. 7Aug10

2.5.6           Any member team operating in contravention of Regulations 2.5.1 through 2.5.5 will be immediately placed under suspension. 7Aug10

2.6          All players from any team not competing in a given season, whether due to disbsanment or Leave of Absence shall be placed in a Disbursement Draft. Such draft to be conducted at the AGM with the lowest team from the previous season having first selection etc. 27Jun10

Regulation 3:      Referees and Linesmen

3.1          All League Games shall be handled by a Referee, Level 4 or higher, registered and in good standing with the Governing Body, together with two linesmen.

Regulation 4:      Schedule

4.1          Each participating member team shall indicate at the Annual Meeting their preference of days and times for their home games. The Statistician in drafting the schedule shall follow these preferences so indicated as closely as possible and equitable. 2001.Jun.09

4.2          The League Schedule shall in all events be subject to ratification by the majority of the participating member teams of the League before it is designated as the regular schedule for the League in any season.

4.3          Upon ratification of the League Schedule, no games shall be rescheduled except with the authorization of the President. 2002Jun15

4.3.1       Excepting due to weather conditions, or other exceptional circumstances as determined by League Executive, teams at fault causing unplayed or uncompleted games are to be subject to a League fine of five thousand dollars ($5,000.00), twelve hundred dollars ($1,200.00) of which shall be used to reimburse the opposing team. The Aat-fault@ team shall automatically forfeit that game and the game shall be recorded by the League Statistician as having been played with a loss shown against the forfeiting team and a win credited to the other team. Games cancelled due to weather conditions must be re-scheduled and played. A lack of players shall NOT be deemed an exceptional circumstance. Any team not paying the fine by the required date is to be suspended until the fine ($5,000.00) is paid to the League. 30May2009

4.3.2       Any unplayed game of the League Schedule must be re-scheduled within at least two weeks of the originally scheduled game except for the last three weeks of the Regular Schedule, during which time the Statistician will coordinate with the two teams involved. 2001.Jun.09

4.4          If the provisions of paragraph 4.3.2 cannot be implemented and the team requesting the re-scheduling is unable to play the game scheduled, that team shall automatically forfeit that game and the game shall be recorded by the League Statistician as having been played, with a loss shown against the forfeiting team and a win credited to the other team. Fine and reimbursement as per 4.3.1 above shall apply. 2002.Jun.15

4.5          In the event of a tie for any position at the conclusion of the Regular Schedule, the position shall be determined in accordance with: 12.SEP.95

4.6          All Regular and Play-off games shall commence no earlier than 7:00 p.m. and no later than 9:00 p.m. unless approved by the President. 2001Jun15

Regulation 5:      Games

5.1    All League Games will be comprised of three twenty minute periods with a five (5) minute sudden victory overtime to be played in the event of a tie. If no goal is scored in the five minutes then a shootout will be held. The format shall be a three man shootout; the three players to shoot will be named by their respective teams at the end of Regulation time and prior to the start of the overtime period. Failure to comply with this would result in the first three players on the game sheet to be named. The goaltender can be of the teams choice. If still tied it will become a sudden victory shootout, utilizing all remaining players; if necessary, once all players have had a shot the same rotation shall be followed. Home team shall have the option of shooting first or second.. 29May10

5.2 All games MUST be played in the Home team’s normal venue. Under extenuating circumstances the League President may authorize a game to be played in a neutral rink as close to the Home team’s rink as possible. 29May10

Regulation 6:      Playoffs

6.1          The League Playoffs shall commence as soon as first ice is available following the completion of the Regular Schedule. 2000.JUN.14

6.1.a       During all series leading to Divisional Championship, Home Ice Advantage shall be awarded to the teams who finished highest in the regular season. 14 JUN 03

6.1.b       In the Provincial Championship series, Home Ice Advantage shall be decided by the cross division games between each team during the Regular Season, using:

1)       Games won between the two teams

2)       Points earned between the two teams

3)    Goals for between the two teams

4)    Goals against between the two teams

5)    Flip of a coin. 21 Jul 07

6.1.c       The format to be used in all playoff series shall be decided by the Board of Governors at a Special Meeting each year and by majority vote. 2000.JUN.14

6.2          Teams participating in the League Playoffs may arrange their own playoff dates provided that they are completed by the date set by the President. In the event that no agreement can be reached between the teams concerned, the President shall set the dates of all said games and confirm in writing. 2002Jun.15

6.3          In any League Playoff series, the team which finishes the highest in the final League standing shall be the home team. 2001.Jun.09

6.4          If a minimum of six clubs constitute a regular League, with one division, the League Playoffs shall consist of the first four teams with the highest finish, with subsequent teams being eliminated from the Playoffs. 2001.Jun.09

6.4.1       If the league comprises of two or more divisions, the League Playoff format shall be decided annually, by majority vote, at a regular Board of Governors Meeting. Such decision shall be made prior to the commencement of the Regular Season. 2001.Jun.09

6.5          When teams are tied at the end of the game, continued play shall be as per Hockey Canada rules for overtime. 2001.Jun.09

Regulation 7:      All-Star Team

7.1          There will be two All-Star Teams established annually, one from each division, to be chosen in the following manner: 2001.Jun.09

7.1.1       Each team shall compile a list of not more than eight players (1 Goaltender, 2 Defencemen, 5 forwards) who in their estimation could make their Divisions All-Star Team, and submit to the Secretary no later than the last Friday of November. Regulation 11.4 will apply. 2002.Jun.15

7.1.2                       a)            The Secretary will compile a list, for each division, and submit to all clubs, in their respective division no later than the first Friday in December, to be voted on as indicated hereafter. 2002Jun15

b)            Completed ballots are to be submitted to the Secretary no later than the third Friday in December. Regulation 11.4 will apply. 2002Jun15

c)                   The Secretary shall tally the votes and forward the All-Star Team rosters to all teams no later than the fourth Friday in December. The teams at this time will consist of two (2) Goalkeepers (Leading keeper at Christmas break and 1 by voting), three (3) Defencemen, and five (5) forwards. 29 Jul 06

d)                   On completion of Regulation 7.1.2.c all teams shall forward to the Secretary the names of one forward and one defenceman from their team to be added to the All-Star team roster. 29 Jul 06         

 e)           Any team not complying with 7.1.1 or 7.1.2.b shall also forfeit their rights to have players on the All-Star Team. 2008May31                                

7.1.3       Teams are not to vote on players of their own team, but shall pick two choices for Goalkeeper, four choices for Defence and six choices for Forward. 29 Jul 06

7.1.7       The All-Star Coaches shall be the coach of the Division leading teams at the Christmas break. 29 Jul 06

7.1.8       The All-Star Coaches shall be permitted to replace any player who is unable to perform due to injury or other reason. This player or players shall be selected from the All-Star nomination by order of merit. 2001.Jun.09

7.2          The All-Star Game between the Fred Fox Division All-Star Team and the Sid Rowe Division All-Star Team shall be played annually and is to be held by the 3rd Sunday of January, the locale of the game to be decided on a rotating basis ( East in odd years, West in even years) at a League Meeting no later than September 30th. 29 Jul 06

7.3          The host team shall be responsible for all game arrangements and shall keep the League Secretary fully advised of all game arrangements. 12.SEP.95

7.4          The total costs/profits of any All-Star Game shall be the sole responsibility of the host team. 12.SEP.95

7.5          Any player who fails to show for any All-Star Game, after having originally given intent to play, will be assessed a twenty five dollar ($25.00) fine to be paid to the League by the player's team, prior to the player being able to participate in another League game. 12.SEP.95

Regulation 8:      Awards

8.1         The Secretary shall be responsible to ensure that each of the participating member team coaches shall nominate four persons from any team for awards in categories which are to be awarded annually. This will be done by memos from the coaches to the Secretary, on completion of the regular league schedule, prior to playoffs. The Secretary will forward name/team of all nominees to the coaches by memo. Voting on the following awards shall be 1st, 2nd, 3rd and 4th choice for each place, with voting to be done by the Team coaching staff. This voting must be submitted to the Secretary within 7 days of the final regular season game. 15.Jun02

8.2          Annual Awards shall be announced by the President, within seven days of League Playoffs being completed. 2002Jun15

These points will be tallied and the award presented to the winner at the end of the championship game. 11.FEB.98

8.5                The provisions of Regulation 11.4 will apply to Regulations 8.1 and 8.4. 2002Jun15

8.6          Any team not complying with 8.1 or 8.4 shall also forfeit their rights to have players/coach/executive eligible to win any awards which are voted on. 2008May31

Regulation 9:      Remuneration

9.1          The League President shall receive a yearly honorarium of Five Hundred and Fourty Dollars ($540.00). 2008May31

9.2          The League Vice-Presidents, to a maximum of two, each shall receive a yearly honorarium of Three Hundred and Eighty-Five Dollars ($385.00). 2008May31

9.3          The League Secretary shall receive a yearly honorarium of Three Hundred and Eighty-Five ($385.00). 2008May31

9.4          The League Treasurer shall receive a yearly honorarium of Three Hundred and Eighty-Five Dollars ($385.00). 2008May31

9.5          If the League Secretary and League Treasurer are combined and held by one and the same person, then the League Secretary/Treasurer shall receive a yearly honorarium of Four Hundred and Twenty-Five Dollars ($425.00). 2008May31

9.6          The League Statistician shall receive a yearly honorarium of Three Hundred and Eighty-Five Dollars ($385.00). 2001.Jun.09

9.7.1           The League Publicity Director shall receive a yearly honorarium of Three Hundred and Eighty-Five Dollars ($385.00). 2008May31

9.8          The League Website Director shall receive a yearly honorarium of Three Hundred and Eighty-Five Dollars ($385.00). 2008May31

Regulation 10:   Executive Travel 17Jul02

10.1        Expenses for Executive travel is available to be paid by the League as follows: 17Jul02

10.1.1     reimbursement for automobile travel at rate in Schedule B. 17Jul02

10.1.2     reimbursement of actual lodging costs, within reason. Where at all possible, and applicable, rooms shall be shared by two people. 17Jul02

10.1.3     a meal allowance based on rates listed in Schedule B. Where exceptional circumstances exist meals may be reimbursed at actual cost (receipts required). 17Jul02

10.1.4     a miscellaneous allowance of $4.00 per each complete overnight stay. 17Jul02

10.2        The President or his designate must be in attendance during a Provincial Playoff game where the Championship may be won. If sufficient funds are available other Executive members may be authorized to attend at League expense. 17Jul02

10.3        The President or his designate must be in attendance during the Don Johnson Cup. If sufficient funds are available other Executive members may be authorized to attend at League expense. 17Jul02

10.4        Where an Executive member is on League business and such business prevents that member from returning home so as to arrive prior to 1:00am, or driving conditions are such that driving would be hazardous, expenses shall be paid in accordance with Regulation 10.1 above. 17Jul02

Regulation 11:   Miscellaneous

11.1        All expenses in connection with the operation of the League not specifically dealt with in these By-Laws or Regulations shall be paid for from the League Treasury, provided they are approved for payment at a properly constituted League Meeting. 17Jul02

11.2        All League Game Reports shall be faxed by the home club not later than thirty minutes after game completion to the FAX-to-email number and mailed to the League Statistician within forty-eight hours after game completion. Failure to comply with this Regulation will result in a fine of Fifty Dollars ($50.00). 30May09

11.3        Any levied fines not received by the League by the specified date will automatically be doubled, and if not paid within forty-eight hours (48 hrs), the franchise may be suspended. 17Jul02

11.4        Any request for information issued by the Secretary-Treasurer and bearing a deadline date which is not met with will result in a fine of One Hundred Dollars ($100.00). 17Jul02

11.5        All goal nets must be pegged. Any problem with this is to be referred to the President. 17Jul02
